Breaking! Federal judge in Va. strikes down health care law

This just in from the Associated Press:

A federal judge in Virginia has declared the Obama administration's health care reform law unconstitutional.

U.S. District Judge Henry Hudson is the first judge to rule against the law, which has been upheld by two others in Virginia and Michigan.

Virginia Attorney General Ken Cuccinelli filed the lawsuit challenging the law's requirement that citizens buy health insurance or pay a penalty starting in 2014.

He argues the federal government doesn't have the constitutional authority to impose the requirement.

Other lawsuits are pending, including one filed by 20 states in a Florida court. Virginia is not part of that lawsuit.

The U.S. Justice Department and opponents of the health care law agree that the U.S. Supreme Court will have the final word.

I pray that other federal judges will join this Virginia judge!

"I don't worry about the Constitution"

  He doesn't care what the Constitution says? A congressman or woman is to defend and carry out the laws of our Constitution. It is their job! The Constitution tells us how government is to be carried out, and without it we would be a chaotic nation. This congressman did definitely stick his foot in his mouth, but I'm afraid it shows the beliefs of to many people in government.

  If we do not honor our founding documents, our country will fall apart! It already is because leaders like this man are not obeying the laws that they are supposed to protect!

  We must know the laws we are under too. If we do not know, and follow our founding documents how can we help our country become a better nation? America must work on the restoration of the knowledge of God, and our founding documents.

We Must Not...

These past few days after the vote on health care I have been stewing over in my mind about what to do now.  However, the first things that came into my were not what we SHOULD be doing, but what we must NOT do.

 

We must not....

  1.  (if you were against the bill) get angry
  2. (if you were fr the bill) gloat
  3. use violence to make a point.
  4. call leaders names and lash out at people who voted against what you wanted

All of these things will not help in the end.They will make matters worse! Even though we may want to do them at times, it isn't right! Now, for the things we must do.

We must...

  1. pray. Pray like crazy because God is the foundation of our Nation.
  2. understand our American history in order to understand the days we live in. 

Keep strong my friends, and keep learning. "Study to show yourselves approved", always know what you believe.

 

 

The Final Hours

Today is the day that a vote is to be taken on the president's heath care plan. Yesterday there was a huge protest outside and inside the capital against the bill. People from all over came to plead with their congressmen to not vote for this bill!

 

  But will it be enough? I can only hope and pray that yesterday made a difference! This morning there is going to be a church service for everyone who came yesterday, to pray for the congressmen and senators. I encourage you all to do the same. We have done all that is humanly and morally possible to stop this bill. It is fully up to God at this point.

If this bill does pass...well I think that if you have read some of my previous articles you know what will happen. However, if it doesn't pass today, I do not believe that the fight will be over! If any of you have ever seen the movie Amazing Grace, you know how they tried and tried to get the abolition of the slave trade passed. The first bill they passed, though, was not an abolition bill. It was a bill dealing with neural flags on merchant ship, and it seemingly had nothing to do with abolition. However, the bill put many slave traders out of business.

I'm afraid that some of out leaders may try the same thing if the heath care bill is not passed today. I again encourage you all to keep praying, and pleading with God to help our government be an honorable government! So in the final hours all we can do is watch and pray, but that may be the best thing to do!

First a Bribe...Now a Threat???

Yesterday I showed you all an e-mail from moveon.org. My article was even recognized and read by Glenn Beck during the first hour of his radio show today! But...moveon is not done. I received ANOTHER e-mail today, in which moveon described how they have already received $1 million in pledges, and now they are asking members to help them get to $2 million!  Here is the newest e-mail, and I have put the parts in bold that seem like veiled threats to moderate Democrats, to me.

"Dear MoveOn member,

Wow! Since Monday, MoveOn members have pledged over $1 million to support progressive primary challengers to House Democrats who vote against health care reform. That's incredible.

But with the final vote just days away, the House is still short a handful of votes.

So we're setting an ambitious new goal to keep the momentum building: $2 million in pledges by Friday. That's a serious sum for any challenger, and will make conservative Democrats think twice before casting a vote....

The Health Care Accountability Pledge is pretty simple: you say how much you'd give to a progressive challenger to support their campaign, and then we publicize the amount pledged, and make sure the media and every wavering representative know about it. Word's already getting out and will only build as the momentum grows.

And we need to keep the pressure up: the House is still a handful of votes short, and the conservative opposition—from the Chamber of Commerce to the National Republican Congressional Committee—is funneling millions into scaring off wavering Democrats.2

This is it. If we succeed, health care reform will be law by next week—but it's going to take an intense, nationwide push to make it happen. "

 

Moveon is trying to send the message loud and clear to all conservative Democrats! They are saying that if they (the democrats) don't vote yes on this bill, moveon will be throwing money at their competitors to make sure the moderates DON'T  win come election time! They aren't just calling and asking congressmen to vote their way, but they are threatening these men's careers!

What has happened to honor? Where are the politicians that are willing to look at money and say, "NO I'm going to vote for what is right, and not on bribes and threats!"? Where are they?

We can only pray that God will raise up an army of honorable leaders that hold to the truth, and will not back down to what is right! 

 

 

A Call for Prayer and Fasting!

I have showed everyone the past few days about the evils of the Health Care bill. Today, though, I was brought back to reality, and reminded Who's hands this bill is in.

We as teens tend to try to show that we KNOW things, and we are smart. We are to an extent, but we have to remember that we are still young and haven't lived as long as most people. This message that I got today from The Eagle Forum shows where our focus needs to be.

Eleanor Smeal didn't know what it was, but we did. We knew that we had the truth on our side and that the good Lord had brought us the votes from the two Chicago legislators who had never voted with us before.

 

And so, in the remaining days and hours before the most crucial vote the U.S. Congress will ever cast, I ask you to pray that Our Lord intercedes in this battle for the future of our nation and that the truth, once again, prevails.

Yes, we need to do our part to speak out against the bill, but we must at the same time fall on our knees and beg God for guidance! Isn't Bribery Unconstitutional?

  In Article II, Sec. 4 of the Constitution it states that, "The president, vice president, and all civil officers of the United States shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors."

  I put bribery in bold because of an e-mail I received today. This is an e-mail that moveon.org sent out to all of it's members regarding the heath care bill.

I don't know about you, but this sounds like moveon.org is going to be throwing money at fence riding politicians to get votes in their favor, or be throwing money to progressives in upcoming elections! This is bribery! This is Unconstitutional.

Teens, listen up! I know we can't vote yet, I know we don't pay taxes yet, but we will have to one day. If this bill passes, we will be the generation paying for it.

Please, America was founded on strong principles and laws. If we carelessly ignore these laws, our future will be doomed.

 

Straight from the Horse's Mouth: The Health Care Bill explains itself

This morning one of my older brothers called me, and said that he was going to be sending me an e-mail that I needed to look at. I said, "OK", but he was adamant that I check it out immediately! The e-mail was from a man who is an MD and had read though the health care bill. This doctor had picked out several major problems with the bill.

Yesterday (March 14, 2010) a new version of the HCB came out, so I wanted to check out what this MD said for myself. It ended up with me reading the first 508 pgs of the 2300 pg HCB! However, trust me, those 508 pgs spoke volumes, and I would like to share with you what I found, along with the information the doctor had, in the HCB.

1.) Pages 30-31 : There will be a government committee that decides what

treatments/benefits you get. On line 13 it states that in the committee there will be "9 members who are not Federal employees or officers and who are appointed by the President."

 

2.) Page 42: The Health Choices Commissioner will choose your HC benefits for you.

 

3.)Page 58: Government will have real-time access to individuals' finances and a "machine-readable health plan beneficiary identification card" will be issued!

 

4.)Page 59 lines 21-24: The government will have direct access to your bank accounts for "electronic funds transfer."

 

5.)Page 65 Sec 164: Is a payoff subsidized plan for retirees and their families

who worked for "an eligible employment based plan that is participating in the reinsurance program." aka: Unions

 

6.) Page 84 Sec 203: Government mandates all benefit packages for private HC plans. There will be a required basic plan, an enhanced plan, and a premium plan.

 

7.) Page 85 Line 7: Specifications of Benefit Levels for Plans. "the benefits under a basic plan are modified to provide for the reduced cost-sharing..." Basically it's means that your heath care will be rationed based on how much you make.

  

8.) Page 95 Lines 8-18: The government will use groups (such as ACORN and Americorps) to sign up individuals for Government HC plan.

 

9.) Page 102 Lines 12-18: Medicaid eligible individuals will be automatically enrolled in Medicaid. You will not have a choice, it will just happen.

 

10.) Page 124 lines 24-25: No company can sue government on price fixing. No "judicial review". So if this bill passes, and then people understand what will happen, they cannot sue the government for it.

 

11.) Page 127 Lines 1-16: Doctors will have a "payment rate", which means the government will tell doctors what salary they can make.

 

12.) Page 146 Lines 22-25: Employers MUST pay for health care for part-time employees and their families. However, employers will be forced to reduce work force benefits, and wages/salaries to cover the huge expense of the health care

 

13.) Page 149 Lines 16-24: Any Employer with payroll 401k or above who does not provide public option will pay 8% tax on all payroll!  

14.) Page 150 Lines 9-13: A business with payroll between $251K & $401K who doesn't provide public option will pay 2-6% tax on all payroll. Here is the chart in the bill that shows how much a business will have to pay if they choose to not have the public option.

15.) Page 167 Lines 18-23: Any individual who  doesn't have acceptable health care according to government will be taxed 2.5% of their income.

 

16.) Page 170 Lines 1-3 HC Bill: Any "Nonresident Alien" is exempt from individual taxes. Americans will have to pay the 2.5% tax, but not illegal aliens!

 

17.) Page 195: Officers and employees of the government health care administration will have access to ALL Americans' finances and personal records.

 

18.) Page 274 Sec 1131: The government mandates and controls productivity for "private" health care industries. So they will not really be private any more, but government controlled!

 

19.) Page 281 SEC. 1145: "Treatment of Certain Cancer Hospitals." - Cancer patients will have rationed health care! "(B) AUTHORIZATION OF ADJUSTMENT.—Insofar as the Secretary determines under subparagraph (A)that costs incurred by hospitals described in section 1886(d)(1)(B)(v) exceed those costs incurred by other hospitals furnishing services under this subsection, the Secretary shall provide for an appropriate adjustment under"
The Secretary will be able to "adjust" the costs if they see fit!

 

20.) Page 289 Sec 1151: The government will penalize hospitals for "excess readmissions in the hospital". Which means that if you go to a hospital for something, your discharged, but you are re-admitted soon the hospital could be penalized!

 

21.) Page 307 Lines 9-11:If doctors treat a patient during an initial admission and that results in a re-admission -- the government will penalize the doctor. This will prevent doctors from doing the multiple test that are some times needed for a patient. 

22.) Page 363 Sec 1177: The government will restrict enrollment of "special needs people!" Those of you that know me, know that I work weekly with people with special needs!

  

23.) Page 435 Lines 5-12: The government mandates "Advance-Care Planning Consult." This includes...

24.) Page 435 Lines 17-19: The government will instruct and consult regarding living wills, durable powers of attorney, etc. All of this is mandatory!

 

25.) Page 435 Lines 22-25, 436 Lines 1-8: The government provides an "approved" list of end-of-life resources; guiding you in death. And if you think that is bad...

 

26.) Page 437 Lines 15-24: The government mandates a program for orders on "end-of-life." "a program that...distributes or makes accessible such orders to physicians and other heath professionals that (acting within the scope of the professional's authority under State law) may sign orders for life sustaining treatment;"

 

27.) Page 439 Lines 1-9: An "advanced-care planning consultant" will be used frequently as a patent's health deteriorates.

 

28.) Page 439 Lines 10-12: An "advanced care consultation" may include an orders "regarding life sustaining treatment or a similar order." Basically this consultant can order your death!

29.) Page 439 Lines 13-25: The government will specify which doctors

can write an end-of-life order! 

 

30.) Page 440 Lines 11-24: The government will decide what level of treatment you will have at end-of-life! This included resuscitation, use of antibiotics, and artificially administered nutrition and hydration. Remember Terri Schiavo!

 

31.) Page 500 Sec 1308: The government will cover marriage and family therapy. They will be telling parents how to raise their kids, and how to deal with marital issues!

 

32.) Page 505-508: Government will cover Mental Health Services including defining, creating, and rationing those services. One word...eugenics! If the government can define mental problems, they can define anyone as having that and "treat them" how they see fit. In the Soviet Union they considered Christianity a "Mental Illness", and thousand of Christians were killed because of it.

Final thoughts

Is this the health care reform that America wants? Is this what we need? NO! A thousand times NO!

Please call the White House, call your representatives, and tell them you know how to read for yourself and you see that this bill will hurt America. Not only will it hurt America it will take away the main virtue that she is known for... FREEDOM!

What does the President's own cousin think of the Health Care bill

This morning on Fox & Friends there was this interview with the president's second cousin, who is a doctor. He had some interesting things to say about his cousin's heath care bill.

WOW! And he is from the president's own family! This is just another warning flag that this bill (as it is now) will not help the American people. Why Wouldn't the President's Health Care Plan Work?

  We hear a lot these days about the health care plan in Washington. Lots of conservative commentators, and some liberal, will tell you how bad this bill is, and that it doesn't need to be passed. A lot of the tea party movement has been against the health care bill. I am opposed to it as it is now.

  However, do you really know why I am against it? Do you really know why the plan wouldn't work? I would like to show some evidences and facts of why I am against this bill (as it is now), and why I think it is wrong.

From a Medical Perspective: 

 For this I turned to my brother, who is an RN in the ER at a local hospital, to find out about this. I asked him how a socialized health care system would affect his overall work system, and why it would be bad. He told me that if this health care bill were to pass, there would be a lot of times where he would have to act, not on science, but on a government bureaucrats decision. Because health care would be regulated by the government, a nurse or doctor would have to have, basically, a federal "OK" to do something. My brother stated that this would discourage learning, and new scientific discovery.

  When I asked my brother whether it would work or not, he said that it wouldn't improve a thing! My brother already has to fill out loads of paper work to keep him from legal suites, and if the government had control of health care, he would have even more! He also said, "Look at anything that any government has socialized, and it is terrible!."

  Sometimes we hear from politicians that there are people that go into hospitals and are refused treatment. However, any medical professional is bound by a law called EMTALA (Emergency Medical Treatment and Active Labor Act), which says that if a patient comes into an emergency center, and is complaining of something, the medical personal HAVE to check him out. It also says that if a pregnant woman, who is in labor, comes into the hospital she must be admitted and treated until the full delivery is completed. So it's not like people who don't have insurance are being thrown out in the cold because of their circumstances. From personal experience, I know that even with surgery procedures there are many charity groups that can help people who do not have insurance at that time.

From a Families Perspective:

  A socialized health care system would basically mean that the government would be running your health care, and therefore would be your decision maker.  

  Let's think about this from a teen's perspective...say you go in for a test, and the doctor comes in and says, "I'm sorry to tell you this, but you have cancer." Obviously you are devastated, and your parents are very worried! The doctor tells you that you will have to start chemo soon. However, when you get home, you parents find out about this new treatment that is being tested on your type of cancer. It is more natural, doesn't have all the chemical harms that chemo does, and has had good success so far.

  Your parents like this, and go to your doctor to ask him about this. He says that yes this treatment is good, but he doubts that you will be able to get it. He tries to get you this new treatment, but your health care official in Washington DC (who has no medical background) says that chemo is tried and true so you will have to have chemo treatment instead of a new natural treatment. Your parents can't do anything about it! You have to have the chemo because the government official says so.

  This could really happen! If we had a government take over of health care it would take away parental decision making on different methods of treatment! Wouldn't it be better if you and your family could pick your own health care provider, at a good price, and make your own decisions on what treatments and tests you wanted? Yes, it would be better, but under the presidents health care plan, government officials would have the final say on what happens to you.

$$$ How much it will cost:

  A recent article from the Heritage Foundation noted that "A closer look at the President's plan shows that:

•Its costs are likely to come in well over $1 trillion over 10 years,

•Ten full years of implementation would cost closer to $2.5 trillion, and

•The plan would make the nation's budget outlook much worse, not better."

  With out national debt at $12.5 trillion, and our federal spending at $3.5 trillion http://www.usdebtclock.org/ , do we really need to be spending this much on a plan that will limit personal choice and increase government control? By the way, we will be the ones paying for all this debt! I don't know about you, but I want as little debt to pay for as I can when I get older!

Conclusion:

  Personally I think that health care reform is needed. However, I don't think that government control and regulation is the answer to that! One solution would be to do away with all the frivolous law and malpractice suites that are placed on doctors. Another one would be to make health insurance available across state lines so that individuals can pick and choose which plan they want. This would increase competition and savings among insurance companies, and give the individual the power to choose in a free market system.  

  However, I am afraid that the president and his team members will not be open to these ideas. The president, Speaker Pelosi, and many others have made it clear that they will get this health care bill passed. But why? Why would they want to do that when so many in America have called for the death of this bill, and to start over? My answer...power. I will leave it at that, and I again encourage you all to learn more about this health care plan so you can fight it! Also remember what Mrs. Werthmann told me about the socialized heath care in Austria.
